About Our Services

El Gauchito Del Sur is a mobile Argentinian food truck and catering service operating in West Palm Beach and throughout Palm Beach County, Florida. We specialize in authentic Argentine cuisine including empanadas, choripan, asado, and other traditional dishes.

Our services include:

• Mobile food truck service at designated public locations for walk-up customers

• Catering for corporate events, private parties, weddings, and festivals

• Online ordering for pickup

• Event booking and coordination

Service Availability

Food Truck Operations

Food truck locations, hours, and menu availability are subject to change without notice due to:

• Weather conditions

• Equipment issues

• Permit requirements

• Private event bookings

• Ingredient availability

We will make reasonable efforts to update our website and social media with current location and availability information.

Catering Services

Catering services are provided by appointment only and subject to availability. All catering bookings must be confirmed in writing via email or through our online booking system.

Orders and Bookings

Online Orders

• All orders placed through our website are subject to acceptance and confirmation

• We reserve the right to refuse or cancel any order for any reason

• Prices are subject to change without notice

• Menu items are subject to availability

• Minimum order requirements may apply

Catering Bookings

• Catering bookings require advance notice (minimum 7 days recommended)

• A deposit is required to secure your booking date

• Final guest count must be provided at least 48 hours before the event

• Menu selections must be finalized at least 72 hours before the event

Walk-Up Food Truck Service

Service Locations and Hours

Our food truck operates at predesignated locations throughout West Palm Beach and Palm Beach County. Current locations, hours, and menu availability are posted on our Instagram (@elgauchitodelsur) and website.

• Service hours and locations are subject to change due to weather conditions, permit requirements, private event bookings, and operational needs

• We are not responsible for travel expenses if you arrive and we are not present due to unforeseen circumstances

• Follow our social media channels for real-time location updates and service announcements

Walk-Up Orders

• Walk-up orders are served on a first-come, first-served basis

• Wait times vary based on order complexity and customer volume

• We reserve the right to limit order quantities during high-demand periods to ensure all customers are served

• Menu items are subject to availability and we may run out of certain items during service hours

• We cannot guarantee all menu items will be available at all times

Payment Methods

• We accept cash and major credit/debit cards (Visa, Mastercard, American Express, Discover)

• Minimum card purchase amounts may apply

• All prices include applicable sales tax

• Tips are appreciated but not required

Pricing and Payment

• All prices are in U.S. Dollars and include applicable sales tax

• Payment is processed securely through Wix payment systems for online orders

• We accept major credit cards and debit cards

• Catering deposits are non-refundable except as specified in our Refund Policy

• Final payment for catering services is due before or at the time of service

Food Safety and Allergies

Food Preparation

We maintain strict food safety standards and comply with all Florida Department of Health regulations. All food is prepared in a licensed commercial kitchen and served from a permitted mobile food unit.

Allergen Information

IMPORTANT: Our menu items may contain or come into contact with common allergens including wheat, eggs, dairy, soy, nuts, and shellfish. While we take precautions, we cannot guarantee that any menu item is completely free from allergens.

Customer Responsibility: If you or your guests have food allergies or dietary restrictions, you must inform us at the time of ordering or booking. We will make reasonable accommodations when possible, but we cannot guarantee allergen-free preparation.

Liability: By ordering from El Gauchito Del Sur, you acknowledge that you understand the risks associated with food allergies and agree that we are not liable for allergic reactions.

Cancellations and Changes

Customer Cancellations

• Food truck orders: May be cancelled up to 30 minutes before scheduled pickup time

• Walk-up orders: Cannot be cancelled once preparation has begun

• Catering bookings: Subject to our Refund Policy (see separate document)

Our Cancellations

We reserve the right to cancel or reschedule services due to:

• Severe weather or natural disasters

• Equipment failure or safety concerns

• Illness or emergency situations

• Circumstances beyond our reasonable control

In the event we cancel, you will receive a full refund or the option to reschedule.

Liability and Disclaimers

Limitation of Liability

To the maximum extent permitted by Florida law, El Gauchito Del Sur, its owner Chef Ed, and TECH CREW FILMS CORP (marketing services) shall not be liable for:

• Food-borne illness (except where caused by our negligence)

• Allergic reactions (when allergen information was not disclosed to us)

• Delays in service due to circumstances beyond our control

• Indirect, incidental, or consequential damages

• Loss of profits, revenue, or business opportunities

Service Disclaimer

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• Services will be uninterrupted or error-free

• All menu items will always be available

• Food truck will be at advertised locations at all times

Maximum Liability

Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific order or catering service in question.

Intellectual Property

All content on our website, including text, images, logos, and menu descriptions, is the property of El Gauchito Del Sur and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

Event Venue Requirements

For catering services, the customer is responsible for:

• Ensuring adequate space for our food truck or service setup

• Providing access to electrical power if required

• Obtaining necessary venue permissions for our service

• Ensuring safe and legal parking for our vehicle

• Complying with venue rules and regulations

Failure to provide suitable conditions may result in service delays or cancellation without refund.

Conduct and Behavior

We reserve the right to refuse service to anyone who:

• Behaves in a threatening, abusive, or disrespectful manner

• Appears intoxicated or under the influence

• Violates health and safety regulations

• Engages in fraudulent activity

Dispute Resolution

Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to contact us to attempt to resolve the dispute informally. Please send written notice to ed.vighetto@yahoo.com describing the issue and desired resolution.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in Palm Beach County, Florida, in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes on an individual basis only and waive any right to participate in class action lawsuits.

Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these Terms & Conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.
